HI there, please advise if there is a binding contract for my uncle to build the road?

My uncle owns Jacob 's commission and his company contracted with California Electric power commission to build an access road. The contract contained the foll: clause: The contractor agrees that he is fully informed regarding all of the conditions affecting work to be done and labour and materials to be furnished for the completion of the contract and that his information was secured by personal investigation and research and not from the commission or its estimates and that he will make no claim against the commission';





The area where the road was to be built was under heavy snow last Winter and the temperature was very low. There was also plenty of muskeg than indicated. My uncle claimed that the property description was inaccurate and claimed to be excused from the contract. Is there a binding contract to build the road?

You have only given us a clause from the contract. Did he sign a contract? Are there other provisions that give conditions to withdraw?


What is the Ca. Electric Power Commission? Certainly not a State agency.
